For purposes of this Privacy Policy, “personal information” shall mean individually identifiable information from or about an individual. We collect personal information when you access certain of the Yardline® Offerings and complete the required information request form(s) and/or otherwise provide such information to us. The information that you must supply on the form(s) may include, without limitation: (a) your full name; (b) your e-mail address; (c) your username and password; (d) your mailing address/your Business Entity’s mailing address; (e) your mobile telephone number; (f) your date of birth; (g) capital requested (where registering to use the Evaluation Generator); (h) your Social Security Number and the EIN of your Business Entity (where registering to use the Evaluation Generator); (i) the name of your Business Entity (where registering to use the Evaluation Generator); (j) the brand name associated with your Business Entity (where registering to use the Evaluation Generator); (k) your Business Entity’s state of incorporation (where registering to use the Evaluation Generator); (l) the average gross margin of your Business Entity (where registering to use the Evaluation Generator); (m) bank statements for your Business Entity (where registering to use the Evaluation Generator); (n) the average monthly gross revenue of your Business Entity (where registering to use the Growth Tool); (o) the year-over-year revenue growth of your Business Entity (where registering to use the Growth Tool); (p) the top seller platform utilized by your Business Entity, and the associated average monthly fees (where registering to use the Growth Tool); (q) the top product type sold by your Business Entity, and the associated average monthly cost of goods sold (where registering to use the Growth Tool); (r) the average monthly advertising costs of your Business Entity (where registering to use the Growth Tool); (s) other expenses of your Business Entity (where registering to use the Growth Tool); and (t) any other information requested by us on the applicable registration form.
Please be advised that items (h) and (l)-(s) in the preceding paragraph shall be referred to as “Sensitive Information.”
Use and Sharing of Personal Information
As further detailed in the “Growth Capital Requests, Third-Party Funding Services, Credit Reports and Access to Account Data” Section below, upon entering personal information in connection with Third-Party Funding Services and clicking on the applicable submission button on the Site: (a) Yardline® may pass your personal information (including Sensitive Information) along to Third-Party Lenders; and/or (b) you may be contacted by one (1) or more Third-Party Lenders regarding your Third-Party Funding request. Any information that you supply to any Third-Party Lender shall be governed by that third-party entity’s privacy policy.
By making that personal information available to Yardline®, you grant Yardline® the right, subject to applicable law, to use that personal information to contact you regarding your use of the Yardline® Offerings, Yardline® products and/or services and/or third-party products and/or services that we think may be of interest to you. If you wish to stop receiving future communications from us, please follow the instructions at the end of each such e-mail message or see the “Opt-Out/Unsubscribe” section below.
We may also employ third parties and individuals to perform certain functions on our behalf, including helping us operate the Yardline® Offerings and/or to administer related activities on our behalf. Examples include sending direct and electronic mail, removing duplicate information from User lists, analyzing data and providing marketing analysis. The agents performing these limited functions on our behalf shall have access to our Users’ personal information as needed to perform their functions for us, but we do not permit them to use User personal information for other purposes.
We will also use your personal information for customer service, to provide you with information that you may request, to customize your experience with the Site and/or to contact you when necessary in connection with transactions entered into by you through the Yardline® Offerings. We may also use your personal information for internal business purposes, such as analyzing and managing our business. We may also combine the information we have gathered about you with information from other sources.
By registering via the Site, you agree that such act constitutes an inquiry and/or application for purposes of the Amended Telemarketing Sales Rule (16 CFR §310 et seq.), as amended from time to time (the “Rule”) and applicable state do-not-call regulations. As such, notwithstanding that your telephone number may be listed on the Federal Trade Commission’s Do-Not-Call List, and/or on applicable state do-not-call lists, we retain the right to contact you via telemarketing in accordance with the Rule and applicable state do-not-call regulations.

We also reserve the right to release current or past Users’ information (including Sensitive Information) in the event that we believe that the User is using, or has used, the Yardline® Offerings: (i) in violation of the Terms, this Privacy Policy or any other of our operating rules, policies, price schedules and other supplemental terms and conditions or documents that may be published by us from time to time; (ii) to commit unlawful acts; (iii) if such information is subpoenaed; provided, however, that, where permitted by applicable law, we shall provide you with e-mail notice, and opportunity to challenge the subpoena, prior to disclosure of any personal information pursuant to a subpoena; (iv) if we are sold, merge with a third-party or are acquired by a third-party (collectively, “M&A Transactions”) (including where we share your personal information in connection with the due diligence process associated with a potential M&A Transaction); (v) if we are the subject of bankruptcy proceedings; provided, however, that if Yardline® is involved in a bankruptcy proceeding and/or M&A Transaction, you will be notified via e-mail and/or a prominent notice on the Site of any change in ownership or uses of your personal information, as well as any choices that you may have regarding your personal information; and/or (vi) when we deem it necessary or appropriate including, without limitation, sharing your e-mail address with other third parties for suppression purposes in compliance with the CAN-SPAM Act of 2003, as amended from time to time, and Federal Trade Commission implementing regulations.
Background Checks and Credit Reporting
After creating an Account, and where you provide subsequent consent, we may implement a dynamic feature that provides you with the ability to monitor and check your status on an ongoing basis. If this feature is implemented by us, you may decide to allow us, separately, to pre-qualify your Account by providing us with additional information and linking your Account on any other platform (including any marketplace, e-commerce, or online sales platform or marketing channel to which you separately agree to provide us with access). To the fullest extent permitted by applicable law, you hereby agree that we may perform an initial background check (and subsequent periodic follow-up checks) on you and any of your principals, managing members, managers, members, stockholders, directors or officers or respective affiliates, to help us determine your suitability or approval for our services (each, a “Background Check”). Each Background Check may, without limitation, include a review of the following information, which you hereby expressly authorize and consent to: (a) your Registration Data; (b) your Business Entity's credit history; (iii) whether your Business Entity, or any of your Business Entity’s directors and officers, have any state or federal convictions and criminal records; (iv) information that is publicly available about your Business Entity and/or any of its directors and officers; (v) information that we obtain from third party service providers, including information derived or prepared by third-party data aggregation and analysis companies; and (vi) whether your Business Entity, or any of your Business Entity's principals, managers, managing members, directors, members, officers, stockholders, or controlling persons, have ever been declared bankrupt. You acknowledge that any failure to provide the foregoing information and said cooperation may preclude you from being approved to participate in, or continue to receive the benefit of, some or all of the Yardline® Offerings.
Growth Capital Requests, Third-Party Funding Services, Credit Reports and Access to Account Data
Users interested in obtaining Yardline® Funding and/or Third-Party Funding can submit materials in connection with such Growth Capital Requests and/or Third-Party Funding requests, respectively, by and through use of the applicable Account interface and/or Dashboard.
After creating an Account with Yardline®:
(A) If you decide to submit a Growth Capital Request;
(B) If you decide to allow us to do a complete pre-approval on an ongoing basis for Growth Capital Requests; or
(C) If you submit a Third-Party Funding request by and through the Third-Party Funding Services; then
(D) You specifically consent to let us request and receive your Business Entity's consumer report data and other data about your Business Entity from third parties to include in your Account profile, and specifically also agree as follows:
You understand that you are authorizing us to access data from your registered Yardline® Account (as well as any other marketplace, e-commerce, online sales platform or marketing channel to which you provide us with access), on an ongoing basis for so long as you have a registered Account. You acknowledge and agree that Yardline® may download data automatically and frequently on an hourly, daily, weekly, monthly and periodic basis. You understand and agree that Yardline® may use such data for its own internal purposes, to use with Yardline’s® affiliates and Third-Party Lenders, for other commercial purposes, and to evaluate with other data or analytics to track and update data through Dashboards available to you and your authorized users that access your Account. You understand that this consent allows Yardline®, the Third-Party Lenders and Yardline's affiliated companies to obtain such information at any time for as long as you have a registered Account.
In any circumstance where you have affirmatively opted-in and consented to submit a Growth Capital Request or have further opted-in and consented to receiving Yardline® Funding offers, Third-Party Funding offers and/or other Yardline® Offerings, you understand that you are providing written instructions in accordance with the Fair Credit Reporting Act and other applicable law for Yardline®, the Third-Party Lenders or Yardline's affiliated companies to request and receive copies of consumer reports, scores and other information about you and your Business Entity from third parties including, but not limited to, the credit reporting agencies: Experian®, TransUnion® and Equifax®. You understand that your instructions let Yardline®, the Third-Party Lenders and Yardline's affiliated companies obtain such information at any time for as long as you have a registered Account. You understand that: (a) in submitting a Growth Capital Request, Third-Party Funding request or any other Yardline® Offerings request; and/or (b) if you have been approved for, and are receiving, Yardline® Funding and/or Third-Party Funding in connection with any Growth Capital Request and/or Third-Party Funding request, as applicable, or are receiving any other Yardline® Offerings, your behavior and timing with respect to meeting your financial obligations to Yardline® on a timely basis may also be reported to credit rating agencies, which may have a positive or negative impact on your credit ratings that could be material in affecting future applications for credit and existing credit facilities in place for your Business Entity.

Non-Personal Information Collection and Use
Computer IP Addresses/Browser Type
We may collect certain non-personally identifiable information about you and your desktop computer when you visit many of the pages of the Site. This non-personally identifiable information includes, without limitation, the type of browser that you use (e.g., Safari, Chrome, Internet Explorer), your IP address, the type of operating system that you use (e.g., Windows or iOS) and the domain name of your Internet service provider (e.g., Verizon, AT&T). We use the non-personally identifiable information that we collect to improve the design and content of the Yardline® Offerings and to enable us to personalize your Internet experience. Behavioral Tracking
Yardline® and its third-party partners, such as Google®, use Cookies, pixels and other tracking technology (collectively, “Tracking Technology”) to analyze trends, administer the Site, track Users’ movements around the Site and to gather demographic information about our User base as a whole. In addition, we partner with third-parties to use Tracking Technology in connection with the display of advertising on our Site, and to manage the serving of our advertising to you on other websites when you exit the Site. Our third-party partners may use Tracking Technology to gather information about your activities on the Site and other websites in order to provide you with certain Yardline® advertising based upon your browsing activities and interests. To the greatest extent permissible under applicable law, we are not responsible for the tracking practices of third-parties in connection with the Site.

In addition, Users may be able to disable some, but not all, of this tracking activity by utilizing the “Do Not Track” setting or similar options within most major Internet browsers. Further, Users may be able to opt-out of this form of tracking utilizing the options made available by the Network Advertising Initiative, Facebook or Digital Advertising Alliance. Please note that opting out of this tracking activity does not opt you out of being served advertising. Even where you opt out of this tracking activity, you will continue to receive generic ads.
Cross Device Tracking
Yardline® tracks Users’ use of the Yardline® Offerings across various devices, including your personal computer and mobile device, in order to optimize and personalize your Yardline® Offerings experience. Yardline® may collect certain of your personal information across various devices. Please be advised that where you opt-out of having your use of the Yardline® Offerings tracked across devices, you may need to upload certain information multiple times and/or input your log-in information multiple times.
Aggregate Data
Yardline® reserves the right to transfer and/or sell aggregate or group data about Users of the Yardline® Offerings for lawful purposes. Aggregate or group data is data that describes the demographics, usage and other characteristics of Users as a group, without disclosing personally identifiable information.
Social Media Websites
If you engage in any interaction with Yardline®, other Users or any third-party by and through any Social Media Pages, you should be aware that: (a) the personal information that you submit by and through such Social Media Pages can be read, collected and/or used by other users of these websites/services (depending on your privacy settings associated with your accounts with the applicable Social Media Websites), and could be used to send you unsolicited messages or otherwise to contact you without your consent or desire; and (b) where Yardline® responds to any interaction on such Social Media Pages, your account name/handle may be viewable by any and all members/users of Yardline’s® social media accounts. We are not responsible for the personal information that you choose to submit via any Social Media Websites.
The Social Media Websites operate independently from Yardline®, and we are not responsible for such Social Media Websites’ interfaces or privacy or security practices. Your interactions with the Social Media Pages are governed by the privacy policies of the applicable Social Media Websites. We encourage you to review the privacy policies and settings of the Social Media Pages with which you interact to help you understand those Social Media Websites’ respective privacy practices. If you have questions about the security and privacy settings of any Social Media Pages that you use, please refer to the applicable Social Media Website’s privacy notices or policies.
Third-Party Websites
The Site may contain links to third-party owned and/or operated websites including, without limitation, Social Media Websites. Yardline® is not responsible for the privacy practices or the content of such websites. In some cases, you may be able to make a purchase through one of these third-party websites. In these instances, you may be required to provide certain information, such as a credit card number, to register or complete a transaction at such website. These third-party websites have separate privacy and data collection practices and Yardline® has no responsibility or liability relating to them.
Security of Your Personal Information
We endeavor to safeguard and protect our Users’ personal information. When Users make personal information available to us, their personal information is protected both online and offline (to the extent that we maintain any personal information offline). Where our registration/application process prompts Users to enter Sensitive Information, and when we store and transmit such Sensitive Information, that information is encrypted with advanced TLS (Transport Layer Security).
Access to your personal information is strictly limited, and we take reasonable security measures to ensure that your personal information is not accessible to the public. All of our Users’ personal information is restricted in our offices, as well as the offices of our third-party service providers. Only employees or third-party agents who need User personal information to perform a specific job are granted access to User personal information. Our employees are dedicated to ensuring the security and privacy of all Users personal information. Employees not adhering to our firm policies are subject to disciplinary action. The servers that we store User personal information on are kept in a secure physical environment. We also have security measures in place to protect the loss, misuse and alteration of personal information under our control.
Please be advised, however, that while we take every reasonable precaution available to protect your data, no storage facility, technology, software, security protocols or data transmission over the Internet or via wireless networks can be guaranteed to be 100% secure. Computer hackers that circumvent our security measures may gain access to certain portions of your personal information, and technological bugs, errors and glitches may cause inadvertent disclosures of your personal information; provided, however, that any attempt to breach the security of the network, our servers, databases or other hardware or software may constitute a crime punishable by law. For the reasons mentioned above, we cannot warrant that your personal information will be absolutely secure. In compliance with applicable federal and state laws, we shall notify you and any applicable regulatory agencies in the event that we learn of an information security breach with respect to your personal information. Please be advised that notice may be delayed in order to address the needs of law enforcement, determine the scope of network damage, and to engage in remedial measures.
Fraud Detection and Account Security
We are committed to stopping fraud and reserve the right to take all reasonable measures to detect and prevent it. For security purposes, we may view, monitor, and record activity undertaken by and/or through the Yardline® Offerings without notice or permission from you. Any information obtained by monitoring, viewing, or recording may be subject to review by law-enforcement organizations in connection with investigation or prosecution of possible criminal activity undertaken by and/or through the Yardline® Offerings. We will also comply with all court orders involving requests for such information. Actual or attempted fraud or other unauthorized use of the Yardline® Offerings may result in criminal and/or civil prosecution and immediate termination of your right to use the Site.
To protect the security of your personal information, we may require you to authenticate your identity (i.e., prove that you are who you say you are) to conduct certain transactions by and/or through the Yardline® Offerings. Use of unique login information may be required to access certain portions of the Yardline® Offerings. You acknowledge that your login information is unique and must be kept private and confidential to protect the security of your Account. You agree not to give or make available your login information to any unauthorized individual. If you believe your login information has been compromised, lost or stolen, someone without authorization has attempted to use your Account, or your Account has been accessed by someone without authorization, you must notify us immediately (using the contact information below). If you lose or forget your login information, contact us immediately. If you fail to notify us, you may be liable for all unauthorized activity on your Account.
Children’s Privacy
The Site is not intended for individuals under eighteen (18) years of age (the “Permissible Age”). No one under the Permissible Age may provide any information to or on the Site. We do not knowingly collect personal information from individuals under the Permissible Age. If you are under the Permissible Age, do not use or provide any information on the Site or through any of its features, register on the Site, or provide any information about yourself to us. Opt-Out/Unsubscribe

Notwithstanding the foregoing, we may continue to contact you for the purpose of communicating information relating to your use of Yardline® Offerings, as well as to respond to any inquiry or request made by you. To opt-out of receiving Yardline® Offerings-related and/or inquiry response-related messages from Yardline®, you must cease requesting and/or utilizing the Yardline® Offerings and/or cease submitting inquiries to Yardline®, as applicable.
